The man was protecting his family, something a real man does. No charges should be brought to this man. The lunatic is where he should be….GONE.
Well, while I have no sympathy for the carjacker and in fact think he deserved what he got, in many jurisdictions, the shooter would be charged. It is clear from the video that by the time the carjacker was shot, his family had exited the car and fled and the shooter was outside the car with the carjacker inside the car and no longer posing a physical threat to the shooter or his family. The shooting prevented the theft of the car. I don’t know if Texas law is okay with that but I do know that a
policeman who shoots a carjacker who is not posing a physical threat solely to prevent the theft of the vehicle would be suspended, charged and probably convicted in most jurisdictions. It appears from the video
there is no racial component here. If the shooter was white and the carjacker was black, you can be sure there would be calls for the shooter’s scalp.
As a followup to my previous post, I am reminded of the prosecutor who
deposed Joe Biden over his taking of classified documents, and who determined that Biden had committed crimes but failed to prosecute because he didn’t think a jury would convict. If that’s the standard, no DA should bring charges against the shooter because it’s hard to envision a jury convicting him given the circumstances. I think the shooter should be investigated though just to make sure his gun was legally obtained and carried and that the shooter himself didn’t have outstanding warrants etc. Only then should the case be closed.
If it happened in NY State, the man who protected his family would be the criminal and the carjacker would be the victim. If the shooter’s gun was unregistered in NYS, the man would be in even more trouble.
